A contract, on the other hand, is both more formal and legally binding\u2014which means it must be documented. &nbsp;<\/p>\n\n\n\n<p>Both an agreement and contract represent specific arrangements between two or more parties. The main differences between contract and agreement lie in their flexibility and enforceability.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is an agreement?<\/h2>\n\n\n\n<p>Like we said before, agreements are often informal. They are a less rigid and formal type of contract: simply, they are an understanding or arrangement between two or more parties, often referred to as&nbsp;&#8220;handshake agreements.\u201d&nbsp;&nbsp;<\/p>\n\n\n\n<p>Agreements are typically verbal. In many places, they&nbsp;<em>are<\/em>&nbsp;legally binding. &nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">When are verbal agreements not legally binding?<\/h3>\n\n\n\n<p>In the United States, a verbal agreement isn\u2019t legally binding when it involves:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The sale or transfer of an interest in land or real estate<\/li>\n\n\n\n<li>Terms that outlast the lifetime of one of the parties (e.g. copyright)<\/li>\n\n\n\n<li>Selling goods valued greater than $500<\/li>\n\n\n\n<li>Marriage or divorce agreements<\/li>\n\n\n\n<li>Terms that will take longer than one year to carry out<\/li>\n\n\n\n<li>Someone\u2019s promise to pay someone else\u2019s debt<\/li>\n<\/ul>\n\n\n\n<p>Chances are, your verbal business agreements aren\u2019t legally binding because due to that third point: you\u2019re probably selling goods for more than $500.<\/p>\n\n\n\n<p>In other parts of the world, like the United Kingdom, when two or more parties agree on services and payment for those services, the contract is binding. Exceptions apply to property purchases or rental agreements, consumer credit contracts and intellectual property rights.<\/p>\n\n\n\n<p>The biggest trouble with verbal agreements vs contracts is that they\u2019re hard to enforce. If there\u2019s no record, courts can\u2019t demand that both parties adhere to the terms of the agreement.
